Hong Kong General Holidays, Statutory Alignment & Financial Settlement

In the Hong Kong Special Administrative Region, holidays operate under two distinct legislative frameworks: General Holidays (governed by the General Holidays Ordinance, Cap. 149, comprising 17 days per year for banks, government departments, and schools) and Statutory Holidays (mandated under the Employment Ordinance, Cap. 57, for all private employees). Under the Employment (Amendment) Ordinance, Hong Kong has systematically phased in additional statutory holidays to achieve complete 17-day parity with general banking holidays.

Statutory Substitution

Section 3 Cap. 149 Sunday Replacement Rule

Under Section 3 of the General Holidays Ordinance, when an official general holiday coincides with a Sunday, the immediately following weekday (Monday) is legally gazetted as an observed substitute general holiday in lieu. However, because Saturday is traditionally classified as a general banking holiday under Section 3(i), holidays that fall on a Saturday are observed on that calendar date without an automatic Monday rollover.

HKICL CHATS, FPS & HKEX Trading

The Hong Kong Monetary Authority (HKMA) and Hong Kong Interbank Clearing Limited (HKICL) suspend Real-Time Gross Settlement via Clearing House Automated Transfer System (CHATS) for multi-currency wholesale wires (HKD, USD, EUR, RMB) on general holidays. Hong Kong Exchanges and Clearing (HKEX) halts securities and derivatives trading. Retail peer-to-peer transfers via the Faster Payment System (FPS) operate continuously 24/7/365.

Workplace Protections

Statutory Holiday Compensation

Under the Employment Ordinance, an employer cannot make payment in lieu of granting a statutory holiday. If an employee is required to work on an official statutory holiday, the employer must provide an alternative holiday within 60 days before or after the statutory date, accompanied by at least 48 hours advance notice, or face statutory prosecution.

Severe Weather Market Trading Mechanism

Under HKEX trading rules implemented in late 2024, Hong Kong securities and derivatives markets maintain full electronic trading operations during Typhoon Signal No. 8 and Black Rainstorm warnings. However, official gazetted statutory general holidays remain complete market closures regardless of weather conditions.
