How Holiday Schedules Work in the United States

In the United States, there is no single national statute requiring private employers to close or pay holiday premiums. Congress designates federal statutory holidays under 5 U.S.C. § 6103, but that statute strictly applies to federal agencies, military administrative branches, and the District of Columbia. Commercial businesses, financial markets, and schools set schedules via separate market conventions, state legislation, and employment contracts.

Under the Fair Labor Standards Act (FLSA), private employers are not required to provide paid days off on holidays or pay extra (such as time-and-a-half) unless guaranteed in an employment contract, handbook, or union agreement.
